Cleveland Guardians merchandise sale delayed following naming rights lawsuit

The Cleveland Guardians were set to launch their official merchandise sale for the upcoming MLB season on Monday, November 15, at 9 a.m. However, it was suddenly postponed without further explanation from the team.

Last month, the Cleveland Guardians roller derby team filed a trademark lawsuit against the MLB team to block the name change from Indians to Guardians.

“There cannot be two ‘Cleveland Guardians’ teams in Cleveland, and, to be blunt, Plaintiff was here first,” the roller derby team wrote in the lawsuit. The team, based in Parma, has been using the name since 2013.

The roller derby team also wrote that having two sports teams with an identical name in the same city would confuse the fans and could cause irreparable harm to the smaller, lesser-known team.

“We have been and continue to be confident in our position to become the Guardians,” the pro ball team added. “We believe there is no conflict between the parties and their ability to operate in their respective business areas.”

Cleveland’s baseball team — previously known as the Indians — announced back in July it would change its name to the Guardians for the 2022 MLB season. It’s the first time the team has changed its name in over a century.

According to the roller derby team’s attorney, the baseball team offered “just four figures” for the name in June, which his client decided to refuse.

The new sale date hasn’t been set yet, and a spokesperson for the Cleveland baseball team declined to comment on the issue.
